Assignment 1: The First Amendment and Trump
You are at the airport during a flight delay when a woman next to you looks up at the TV monitor showing Donald Trump and his upcoming trials for alleged election meddling and conspiring to overthrow the government on Jan. 6, 2021. Immediately she turns to you and says how terrible it is that Trump is being persecuted for exercising his First Amendment right of free speech. She talks for 5 minutes before asking: “So what do you think?” Referencing the textbook “The Power of Free Expression in America” select one or two of the most relevant First Amendment theories to explain why the First Amendment does or does not apply to what Trump is charged with in Georgia and Washington. Then, using additional sources to support your position, state how you would rule on these 2 cases and why.
Assignment 2: Required Standing for the National Anthem
In March 2017, the U.S. Soccer Federation announced a new bylaw requiring all persons representing a Federation national team to “stand respectfully” for the playing of the national anthem. It was in response to U.S. women’s national soccer team star Megan Rapinoe kneeling during the U.S. national anthem, which was her show of solidarity with San Francisco 49’ers quarterback Coln Kaepernick’s kneeling protest in recognition of the Black Lives Matter movement. As the new bylaw goes into effect, someone on the team decides to challenge this as a violation of her First Amendment rights. Is this a First Amendment violation? Present your arguments for or against this policy being a violation of the First Amendment.
Assignment 3: Protesters at Ted Nugent’s New Haven Concert Square off Over Racism
View the picture in the Ted Nugent folder below, read the accompanying story, then identify the First Amendment items that were taking place and at issue here. Address it from the point of view of Ted Nugent and from the point of view of those opposing what they perceive as racial remarks. Following that, put on a robe and pretend you are a Supreme Court Justice upon whom the other justices are awaiting your vote to break the deadlock. What would be your ruling on the rights of the two sides and why?

Find a First Amendment issue in the news, meaning a recent news story not more than 12 months ago and one that the class has not already covered and one you have not already written or spoken about. You must then cite the news story (newspaper, magazine, broadcast) it was in (not an encylopedia or law report or blog), explain what makes it a First Amendment issue and take a position providing not only your perspective, but supporting it with facts (such as court rulings, laws, surveys, et al.) Whatever assertion you make should be supported. Be sure to treat this as you do the other three topic questions. Lastly, it is better to provide more rather than less.
