In January 2022, the Law Commission of England and Wales and the Scottish Law Commission published their joint report on automated vehicles. The report recommends introducing a new Automated Vehicles Act, to regulate self-driving vehicles. It also introduces a new term for the human in the driving seat, namely ‘the user-in-charge’ instead of a ‘driver’, with very different legal responsibilities. In particular, the user-in-charge may have immunity from a wide range of offences related to the way the vehicle drives (e.g. dangerous or careless driving, exceeding the speed limit, running a red light etc.). Moreover, the report proposes no sliding scale of driverless capabilities. This means that a car will either be autonomous or not.
