Objective: Develop an ADR (Alternative Dispute Resolution) simulation video, showcasing your group’s handling of a hypothetical business dispute using ADR techniques.

Instructions:

  1. Case Scenario: Use the facts of the last homework assignment.  A young person who commits theft at your office.  In this scenario, the Judge from last week’s trial has ruled in favor of the company.  However, he has decided that an arbitrator should decide the exact dollar amount that the youth and his/her parents must repay to your business.

  2. ADR Process Components: Your video should include your entire team (if you’re not able to reach one, identify who that is in the submission):

    • Opening Statements: Present both sides of the dispute, explaining their positions and desired outcomes.
    • Mediation or Negotiation Session: Simulate an attempt to negotiate or mediate a resolution, with one group member acting as the mediator.
    • Arbitrator’s Ruling (if unresolved): If no agreement is reached, the arbitrator (another team member) should provide a decision based on the arguments presented.
  3. Suggested Roles:

    • Plaintiff and Defendant Representatives: Each side presents their case.
    • Mediator: Facilitates negotiation efforts to find a resolution.
    • Arbitrator: Issues a final decision if no agreement is reached.
    • Witnesses (optional): Team members may add context as witnesses if relevant to the case.

Format: Record your simulation as a video, clearly structuring each ADR stage. Breach contract using a company and a product
