The Intersectionality of Family Violence and Property Settlements: The Kennon Claim

This is the outline of the paper that I have started. I want this to be the starting point and you write the essay from there.

The Intersectionality of Family Violence and Property Settlements: The Kennon Claim

Ⅰ. Introduction

This section will introduce the issue of family and domestic violence within the context of family law property settlements. This essay will aim to evaluate the impact of domestic violence on property settlements, highlighting how its recognition has evolved over time.

Ⅱ. Historical Context and Property Settlements

To understand the influence of domestic violence on property settlements, we must first examine the procedures and factors considered in property settlements before the case of Kennon v Kennon. This section will explore relevant legislation and case law in effect prior to Kennon v Kennon and the pre-Kennon settlement approaches.

  1. Overview of Property Settlement Procedures:
    • Traditional methods and factors considered in property settlements.
    • Legislative framework and case law prior to Kennon v Kennon.
  2. Influence of Domestic Violence:
    • Initial considerations and treatment of domestic violence in property settlements.

Ⅲ. Case Law: Kennon v Kennon and Subsequent Developments

This section will explore the evolution of case law regarding family violence and property settlements, with a focus on the breakthrough case of Kennon v Kennon. It will examine the influence of this case on subsequent legal precedents and legislative changes.

  1. Kennon v Kennon Case Analysis:
    • Outline of the case and its significance.
  2. Post-Kennon Case Law:
    • Analysis of cases that followed Kennon v Kennon.
    • The impact of these cases on family law and property settlements.
  3. Influence on Legislation:
    • How Kennon v Kennon and subsequent case law have shaped legislative approaches.

Ⅳ. Current Legislation

This section will provide an analysis of the Family Law Act and the recent amendments that have been introduced. It will discuss how these legislative changes reflect the evolving understanding of domestic violence and its impact on property settlements.

  1. Family Law Act Overview:
    • Key provisions relevant to property settlements.
    • Recent amendments and their implications.
  2. Impact of Legislative Changes:
    • How the changes address domestic violence in property settlements.

Conclusion

The conclusion will summarise the key takeaways of the essay, reflecting on the extent to which domestic violence impacts property settlements and how legal and legislative responses have evolved over time. It will also reflect on potential future legal practices and reforms in the context of family violence.

This is the feedback that my teacher provided. I want you to focus on this feedback and expand this outline to make a research paper. “In principle, the topic is fine. My main concern is if it will fit within the word limit. The case law seems important, so my suggestion is that if you need to reduce the scope of the paper then reduce or eliminate the section on future legislation. Also–be careful to avoid having the analysis turn into a descriptive summary of cases…you want to provide a critique/assessment of the current legislation, so you want to preserve space for that.”

This is the details of what the paper has to be

Details of task: The Law Internship requires the completion of a research project EQUIVALENT to 2,000-word scholarly paper (e.g., something analogous to a 15 min. conference presentation/poster). The research project may be a topic of the student’s choice and may be multi-disciplinary, but it must have a strong law, legal policy and/or law reform element and approved by the convenor/host.

Assessment Criteria:

  • The extent to which the paper relates to the work of the internship organisation
  • Understanding and discussion of relevant law
  • Analysis and response to topic
  • Structure including logical development of content.
  • Referencing and compliance with AGLC.
  • Expression and written communication including use of legal terminology, English expression, grammar and punctuation.
