Begin by introducing the case State its name, the court in which it was decided, and provide a couple of introductory lines about the topic it involves. 2. Outline the material facts The purpose here is to provide relevant facts, but keep it brief. Case notes are often quite short, and it is in your analysis that you will score well, as this demonstrates your ability to argue in a legal context. 3. Identify the relevant legal issues Identify the relevant legal rules as they relate to Article 3 and Article 6 and what was decided in the judgment. Tip: be alert that there might be several legal issues. 4. The decision What decision did the court reach? Who delivered the decision and how did the judge/s come to this decision/s? Were there multiple/dissenting judgments? How does it/they relate to the legal issues that you identified? Why did the court reach this decision? Did the court rely on any previous authorities/key judgments? 5. The analysis This is the most challenging part. Does the decision you’ve analysed in the previous section seem logical to you? Does it seem fair? What might you decide? Do you think that the decision could signal problems for the courts in the future? Tip: it might be useful to consider your own views in light of some of the dissenting views. Citation and referencing All sources relied upon in your case note should be cited in accordance with the OSCOLA referencing standard. Bibliography There is NO need to include a bibliography with your case note assignment. The references included in your footnotes should be sufficient. Word count 10% over or under the word count limit is acceptable; however, otherwise you must stay within the limit of 900 words.
